Terms applying to the Laithwaite’s Wine offer

1. THESE TERMS

HyperJar offers a service that covers collection, holding processing and settlement of customer advance payments through the use of the HyperJar application.

By making an advance payment via HyperJar to LAITHWAITE’S (Laithwaite’s/us/we/our) in relation to this offer you agree to these legal terms and conditions (‘Terms’) applying between you and Laithwaite’s. A separate contract between you and Laithwaite’s is created for each advance payment you make (and the rewards that are related to that advance payment). These Terms are made and in accordance with HyperJar’s policies and terms. Please read these Terms carefully and contact us if anything is unclear. All purchases made with Laithwaite’s shall be subject to our separate terms and conditions which may be found here: www.laithwaites.co.uk/terms

2. WHO WE ARE AND HOW TO CONTACT US

2.1       Our company information. Direct Wines Limited t/a Laithwaite’s, a company registered in England and Wales with its registered address One Waterside Drive, Arlington Business Park, Theale, Berkshire, United Kingdom, RG7 4SW and company number 01095091.

3. OUR RELATIONSHIP WITH HYPERJAR

Laithwaite’s uses HyperJar to display offers in the HyperJar App and to act as our commercial agent to manage the collection, holding, processing and settlement of your advance payments to Laithwaite’s and any subsequent redemptions and payments you make to us using your HyperJar payment card at our locations (subject to the restrictions as outlined further in Section 7 below). For the avoidance of doubt Laithwaite’s does not have control over the functioning and availability of the HyperJar App, or the collection, holding, processing and settlement of your advance payments with HyperJar.  As we have no control over the HyperJar app, we are not responsible for any losses that you may suffer from using the HyperJar app.  Any claims for losses must be directed to HyperJar, the operator of the app.

4. OUR RESPONSIBILITIES

Laithwaite’s is the promoter and operator of this offer.

Laithwaite’s has sole responsibility for:

  • the offer
  • these terms and conditions
  • honouring the advance payments you make (and the redemption of any related rewards) by allowing you to use your HyperJar payment card to purchase goods and services from our locations (subject to the restrictions stated in Section 7 below)
  • providing and paying the rewards accrued on your Laithwaite’s balance
  • any goods and services we provide to you

If an offer includes any pricing information, any prices stated will clearly specify all applicable taxes, duties and delivery charges that may apply.

5. OFFER ELIGIBILITY CRITERIA

Participation in the offer is only open to HyperJar accountholders that hold a current HyperJar payment card.

We reserve the right to withdraw or amend the offer at any time, and to decline to accept any further advanced payments from you once the offer has been withdrawn.

6. OFFER LIMITS

We may impose limits on the offers we promote via HyperJar. These will be shown when you make an advance payment. The limits specified have the following meanings:

  • Minimum Advance Payment Amount: this is the minimum value of a single advance payment that you can make to Laithwaite’s. Your advance payment must be equal to or higher than this value.
  • Maximum Total Amount: this is the maximum amount of advance payment you can have to Laithwaite’s at any one time. You will need to redeem some of your balance before you can make any further advance payments.
7. USAGE RESTRICTIONS

You can redeem the advance payments you have made (and any related rewards) at a Laithwaite’s store or at www.Laithwaites.co.uk in the United Kingdom.

Due to technical limitations, you CANNOT spend (redeem) the advance payments you have made to Laithwaite’s (or any related rewards) for the services or sites stated below. If you use your HyperJar card to pay at any of the sites stated below  the payments will be taken from your active electronic money balance in your HyperJar account and NOT from your Laithwaite’s advance payment.

  • Concession sites
  • At a Laithwaite’s store or website outside the UK
8. REWARDS

Each time you make an advance payment to Laithwaite’s you are committing to spend this money online or at one of our stores, subject to the usage restrictions in Section 7. In return for this Laithwaite’s will award you with a 4.8% AGR on advance payments for up to 12 months. After 12 months the AGR will cease to apply, however you will still be able to redeem your advance payment and any rewards earned.

We may also, from time-to-time, provide you with the opportunity to earn extra rewards. Additional terms and conditions may apply to these rewards and these will be made available to you at the time the reward is offered to you.

9. REDEMPTIONS

When you spend (redeem) your advance payments and any related rewards (a “Redemption”) the rewards you have earned will be used first, followed by the advance payment amount you have paid and then, if enabled by you, funds from your active electronic money balance in your HyperJar account.

If a full or partial refund is made of any such Redemption, the order will be reversed so that your electronic money used (if any) will be credited first, followed by the advance payment, and finally the reward element.

You must have a HyperJar account and payment card to spend (redeem) your advance payments and any related rewards. Your advance payments, and any rewards earned on them, cannot be converted into cash.

To end this contract, you simply need to spend (redeem) any balance you have with Laithwaite’s.  There is no obligation on either party to enter into another agreement.

10. REFUND AND RETURNS POLICY

Should you have any problems with the goods or services you receive when you redeem your advance payments, or pay for, using your HyperJar card, the Laithwaite’s standard returns and refund policy will apply. 11. DATA PRIVACY

If you purchase from Laithwaite’s you need to be aware of Laithwaites’ privacy policy as this explains how your Personal Data is stored, used and shared and how you can control and request its deletion. You can find the Laithwaite’s privacy policy at: www.laithwaites.co.uk/privacy.

12. Our Right to End this Contract

Laithwaite’s reserves the right in its sole discretion to terminate the contract or withdraw the Offer.  On termination you must spend any balance in your Laithwaite’s jar within 90 days to receive the rewards associated with the jar.  If you do not spend the balance within the 90 days any balance will be refunded (without rewards) to your active electronic money jar in your HyperJar account

These Terms remain in effect after your account or the Offer is terminated or withdrawn.

13. Changes to these Terms and the Conditions of Use

Laithwaite’s may change these Terms and Conditions of use at any time without notice, effective upon posting the amended Terms and Conditions of use to the app. In the event that the Terms and the Conditions of use are amended you will be asked to accept those revised Terms and Conditions of use when you next use the app. Any use of the app thereafter will be on the basis of those revised Terms and Conditions of use.

14. Events Outside Our Control

We are not responsible for failures outside our control.  If Laithwaite’s is unable to carry out its obligations due to an event beyond our control we will contact you as soon as possible to let you know what we will do to minimise the effect.  Provided we do this we will not be responsible for any losses you may suffer.

15. Jurisdiction

These Terms and conditions of use are governed by and to be interpreted in accordance with the laws of England and in the event of any dispute arising in relation to these Terms the English courts will have jurisdiction.
